DEFINITION OF WHITE-COLLAR CRIME
"White-Collar Crimes" are generally commercial in nature and
are often committed by a person, individual or corporate, of
respectability and high social status in the course of his
occupation for financial gain.  Therefore, white-collar-crime
overlaps with corporate crime because the opportunity to
commit such crimes is more readily available to white-collar
employees than non-white-collar employees.  Thus individuals
and business entities such as corporations may be charged
with white-collar crimes.


DEFENSES & PUNISHMENT OF WHITE-COLLAR CRIME
Penalties for white-collar offenses are similar to those for“blue-
collar crimes” and include: fines, home detention, probation,
confinement, court costs, forefeiture of assets, restitution.  
White-Collar-Defendants generally have at their disposal the
same defenses available to any non-white-collar defendant,
with “entrapment” being a common defense.


ENFORCEMENT OF WHITE-COLLAR CRIME LAWS
Federal agencies and well as the states are empowered to
prohibit and punish white-collar-criminal activity.  A number of
well known federal agencies are responsible for prosecuting
white-collar-crime at the federal level: The FBI, the IRS, the
Secret Service, U.S. Customs, the EPA, and the SEC.  At the
state level, Texas employs its own agencies for the
investigation and punishment of white-collar-crimes.  Often,
however, federal and state agencies work together in larger
white-collar cases or cases involving large sums or large
numbers of participants.


KINDS OF WHITE-COLLAR CRIMES
White-Collar Crimes include but are not limited to:

Embezzlement
Embezzlement is the misappropriation of money or property
for personal use by one to whom such money or property has
been entrusted.

Anti-Trust Violations
Certain practices deemed to hurt businesses or consumers or
both, or generally to violate standards of ethical behavior
usually accomplished by anti-competitive measures.

Computer and Internet Fraud
Includes using or applying for credit cards online under false
names, unauthorized use of a computer, manipulation of a
computer's files, computer sabotage, etc.

Credit Card Fraud
Includes unauthorized use of a credit card to obtain
merchandise or money.

Financial Fraud
Financial Institution Fraud (FIF) involves fraud or
embezzlement occurring within or against financial institutions
that are insured or regulated by the U.S. Government.
